Declaration of fitness, assumption of risk and release of liability

Organiser: ADVENTURE MOUNTAIN TOURISM AND BIKE S.L. (trade name First Route MTB), tax ID (CIF) B88549357, Av. Príncipe de Asturias 45, 28860 Paracuellos del Jarama (Madrid, Spain). Instructor: Jorge Gálvez. Contact: info@firstroutemtb.com · +34 606 290 459.

Activity: 3-hour mountain bike (MTB) lessons in El Pardo (Madrid): the one you book in this form and any further lessons you book with First Route MTB. This document applies to all of them; if my health or any of the details below change, I will tell the instructor before my next lesson.

The participant (or their mother, father or legal guardian if they are a minor) declares and accepts the following:

  1. Nature of the activity. I understand that mountain biking is an outdoor sport, on natural and uneven terrain, with inherent risks that cannot be completely eliminated even when all precautions are taken: falls, knocks, grazes, sprains, fractures and other injuries, including serious ones. I am also aware of the risks of the environment: stones, roots, drops, dust or mud, changes in the weather, heat, animals and other trail users.
  2. Physical fitness and health. I declare that I am in suitable physical condition and health for a 3-hour activity on the bike and that I have no injury, illness or medical contraindication that prevents me from taking part. I undertake to tell the instructor, before starting, anything he should know (for example, allergies, medication or recent injuries).
  3. Truthful level. The information I have given about my MTB experience and level is true. I understand that the lesson is adapted to that level and that giving false information increases the risk.
  4. Safety equipment. I will wear an approved, properly fitted helmet throughout the activity; without a helmet I will not be able to take part. Gloves and glasses are recommended. My bike (if I use my own) will be in good condition, especially the brakes, wheels and steering.
  5. Rules and instructions. I will follow the instructor’s directions at all times, I will not attempt exercises or sections beyond my level or that the instructor has not indicated, and I will respect traffic rules, the rules of the natural area and other users. The instructor may change, interrupt or cancel the lesson, or exclude a participant, if he considers there is a risk to their safety or that of the group.
  6. Loaned bike. If I use a bike or equipment belonging to First Route MTB, I will use it carefully and return it in the same condition. I will be responsible for damage caused by misuse or negligence, but not for normal wear and tear or damage resulting from correct use.
  7. Belongings. First Route MTB is not responsible for the loss of or damage to personal belongings during the activity.
  8. Assumption of risk and release of liability. I take part voluntarily and accept the inherent risks of the activity described above. I release ADVENTURE MOUNTAIN TOURISM AND BIKE S.L., First Route MTB and its instructor from liability for damage resulting from those inherent risks or from my own conduct: not following instructions, going beyond my level, not wearing a helmet or having concealed information about my health or my level. This release does not cover damage caused by wilful misconduct or negligence of the organiser or the instructor, nor does it limit the rights that the law recognises as non-waivable.
  9. Insurance. First Route MTB has accident insurance and civil liability insurance for this activity.
  10. First aid. In the event of an accident, I authorise the instructor to give me first aid and to call the emergency services (112) and the emergency contact I give below.
  11. Minors. If the participant is under 18, their mother, father or legal guardian signs this document on their behalf, authorises their participation and accepts all of the above.
  12. Images (optional). I choose below whether I authorise First Route MTB to use photos or videos of the lesson in which I appear on its website and social media (@firstroute_mtb). I can withdraw this authorisation at any time by writing to info@firstroutemtb.com.
  13. Data protection. The data controller is ADVENTURE MOUNTAIN TOURISM AND BIKE S.L. The data in this document is used to manage the lesson and to prove acceptance of these terms, on the basis of the contractual relationship and the organiser’s legitimate interest. It is kept for as long as liabilities may arise (as a general rule, 5 years) and is not shared with third parties unless required by law or in an emergency. You can exercise your rights of access, rectification, erasure, objection, restriction and portability at info@firstroutemtb.com, and complain to the Spanish Data Protection Agency (aepd.es).
